SEC’s Khuzami Indicates Crackdown on Insider Trading Will Extend Beyond Equities

Following the establishment of its new enforcement division earlier this year, this week, the US Securities and Exchange Commission (SEC) has indicated it will be broadening the remit of its insider trading investigations to cover markets beyond equities. The division, which is headed by director Robert Khuzami, will be focusing its investigations on complex instruments such as derivatives as part of the regulatory community’s crackdown on hedge funds.

CFA Institute Survey Highlights Industry Support for Third Party Valuations

The majority of the members of the Chartered Financial Analyst (CFA) Institute Centre for Financial Market Integrity believe that alternative investment fund managers should be mandated to appoint an independent third party for the valuation of assets, according to a recent survey by the group. The survey, which examines the fund management industry’s views on the requirements of the proposed European Alternative Investment Fund Managers Directive, indicates that 81% of respondents are in favour of mandatory third party valuations provision.

Understanding the Regulatory Crackdown on Hedge Funds

Much like last month’s discussion of the current regulatory crackdown on ratings agencies, hedge funds are also facing the wrath of the regulators due to their perceived role in the financial crisis. The lack of transparency in the hedge fund sector has meant that both the European Commission and the US regulators are keen to compel these funds to provide more data concerning their practices. The proposed regulations have proved controversial, however, as many feel they may have a negative impact on the sector as a whole.

UK FSA Launches New Study into the Impact of Hedge Fund Regulations

The UK Financial Services Authority (FSA) has commissioned a new report into the potential costs and impact involved in the implementation of European regulation concerning the alternative investment sector. The regulator has appointed consultancy firm CRA International to conduct the independent study, which will assess the implications for markets and investors, and the potential costs and benefits of the draft legislation published by the European Commission earlier this year.

US Lobbies Europe to Relax Proposed Hedge Fund Regulation

The US government has been engaged in a war of words with European regulators this month in order to ensure that recently proposed hedge fund legislation, which could negatively impact US-based funds doing business in the region, is altered. The proposed Alternative Investment Funds Directive is set to place stricter disclosure and capital requirements on hedge funds, private equity and other alternative investment funds that operate in Europe.

IOSCO Pushes for Mandatory Registration of Hedge Funds

The International Organisation of Securities Commissions (IOSCO) has thrown its weight behind the proposals by US and European regulators to introduce mandatory registration of hedge fund managers. The regulatory community is keen to restore investor confidence in the sector by providing additional transparency into the market, which has been, often unfairly, lambasted as a culprit in the collapse of the financial system last year.

US Reform Measures Likely to Result in Significant IT Overhauls for Regulators and Market Participants Alike

Following months of debate and wild speculation within the market, the Obama administration has this week released its full set of proposals to overhaul the US regulatory framework. At the beating heart of the restructure is the desire to better police those institutions deemed systemically important and, to this end, it grants significant new powers to the Federal Reserve to ensure market stability. The proposals stop short of recommending a full consolidation of the current patchwork of regulators, as first feared by the regulatory community, but does include new obligations for hedge funds, ratings agencies and those involved in the derivatives markets.

New EU Hedge Fund Regulations Conflict with MiFID Requirements, Says Gide Loyrette Nouel’s Puel

The recently published European Union draft directive for hedge funds conflicts with some of the requirements of MiFID and adds another layer of confusion into the market, according to Stephane Puel, partner in the Investment Funds Group of French law firm Gide Loyrette Nouel. The directive, which has come under heavy critical fire from the industry over recent weeks, seeks to tighten up the oversight of these previously lightly regulated market players.

Sequel to MiFID May be on the Cards in the Near Future…

Given the turmoil that the market has been faced with over the past 12 months and the ongoing regulatory overhaul, it was only a matter of time before a follow-up to MiFID was mooted by the regulatory community. Over recent months, the European Commission has been busy assessing whether the directive’s principle of levelling the competitive playing field should be extended to the fixed income and derivatives markets.
